Welcome to read the ConfigTool User Service Agreement (hereinafter referred to as "this Agreement"). The terms and conditions set forth in this Agreement apply to your use of various products and services of ConfigTool Web, App/mini-program (collectively referred to as "ConfigTool Products").
1.1 Shenzhen San-Max Intelligent Connection Technology Co., Ltd. is the R&D entity and right holder of ConfigTool Products. Shenzhen San-Max Intelligent Connection Technology Co., Ltd. and its affiliated enterprises (collectively referred to as "San-Max") agree to provide ConfigTool-related product services based on the Internet and mobile networks in accordance with the operating rules stipulated in this Agreement.
1.2 Users of ConfigTool Web, App/mini-program (hereinafter referred to as "Users") shall, on the basis of understanding all the contents of this Agreement and independent thinking, recognize and agree to all the terms of this Agreement and complete the entire registration process in accordance with the prompts on the page. The User's registration, login, use and other behaviors shall be deemed as full acceptance of this Agreement and all rules and norms announced by Shenzhen San-Max Intelligent Connection Technology Co., Ltd.
1.3 Shenzhen San-Max Intelligent Connection Technology Co., Ltd. has the right to supervise, prompt, inspect, correct and exercise other rights over all activities on ConfigTool Products.
2.1 The specific content of ConfigTool Products shall be provided by Shenzhen San-Max Intelligent Connection Technology Co., Ltd. according to actual conditions, including but not limited to authorizing Users to upload, search and push relevant information to associated Users through their accounts, authorizing Users to collect, share and perform other operations on such information. Shenzhen San-Max Intelligent Connection Technology Co., Ltd. has the right to upgrade or make other adjustments to the form of services or products it provides, and shall notify Users by means of content updates on the App/mini-program/website, without notifying Users individually.
2.2 ConfigTool Products provided by Shenzhen San-Max Intelligent Connection Technology Co., Ltd. may include advertisements, and Users agree to display advertisements provided by Shenzhen San-Max Intelligent Connection Technology Co., Ltd., its affiliated companies, third-party suppliers and partners during use.
2.3 Shenzhen San-Max Intelligent Connection Technology Co., Ltd. only provides technical services related to ConfigTool Product services. In addition, equipment related to the relevant network services (such as personal computers, mobile phones, and other devices connected to the Internet or mobile networks) and the required fees (such as telephone and Internet fees for accessing the Internet, mobile phone fees for using mobile networks) shall be borne by Users themselves.
3.1 Due to the particularity of network services (including but not limited to force majeure, network stability, system stability, technical failures, User's location, User's shutdown, User's mobile phone viruses or malicious network attacks, and any other technical, Internet, communication line, content infringement and other reasons), Users agree that Shenzhen San-Max Intelligent Connection Technology Co., Ltd. has the right to interrupt or terminate part or all of ConfigTool Products at any time. Shenzhen San-Max Intelligent Connection Technology Co., Ltd. will notify Users in a reasonable manner as timely as possible and try to repair it as soon as possible. However, Shenzhen San-Max Intelligent Connection Technology Co., Ltd. shall not be liable for any losses caused to Users due to their inability to send, receive and read information, or send and receive wrong information, and Users shall bear the above risks.
3.2 Users understand that Shenzhen San-Max Intelligent Connection Technology Co., Ltd. needs to conduct regular or irregular maintenance and inspection on the equipment providing ConfigTool Products or related equipment. If the service is interrupted within a reasonable period due to such circumstances, Shenzhen San-Max Intelligent Connection Technology Co., Ltd. will notify Users in advance as much as possible, but shall not be liable for this.
3.3 If the personal information provided by Users is untrue, or Users violate laws, regulations, national policies or the usage rules stipulated in this Agreement, Shenzhen San-Max Intelligent Connection Technology Co., Ltd. has the right to interrupt or terminate the provision of ConfigTool services under this Agreement to Users at any time, without being liable to Users or any third parties.
4.1 When applying for registration of ConfigTool Products, Users must provide accurate subject information to Shenzhen San-Max Intelligent Connection Technology Co., Ltd. (for individual Users, including name, gender, date of birth, telephone number, email, etc.; for corporate Users, including name, registered address, registration number, etc.). If there is any change in the subject information, it must be updated in a timely manner. Any losses caused to both parties of the Agreement or third parties due to the untruthfulness of the information provided by Users shall be borne by Users.
4.2 After successful registration, Users will obtain a Juxue account and a password set by themselves. Users shall be responsible for keeping the user account and password; Users shall be legally responsible for all behaviors under the user account.
When using ConfigTool, Users must abide by the following principles:
4.3 Users shall not use ConfigTool Products to create, upload, send or disseminate sensitive information and information that violates national legal systems, including but not limited to the following information:
4.4 Users agree not to use other Users' accounts or passwords under any circumstances. When you suspect that others are using your account or password, you agree to immediately notify Shenzhen San-Max Intelligent Connection Technology Co., Ltd.
4.5 Users have the right to modify or delete personal information, registration information and transmitted content in ConfigTool Products, but deleting relevant information will also delete any text and pictures stored by you in the system. Users shall bear this risk.
4.6 If Users violate any terms of this Agreement, Shenzhen San-Max Intelligent Connection Technology Co., Ltd. has the right to terminate the provision of ConfigTool services to the defaulting Users under this Agreement in accordance with this Agreement.
4.7 If Users do not log in to the ConfigTool account for a long time after registration, Shenzhen San-Max Intelligent Connection Technology Co., Ltd. has the right to recover the account to avoid resource waste, and Users shall bear all problems arising therefrom.
5.1 Any text, pictures, logos, audio and video materials contained in ConfigTool Products provided by Shenzhen San-Max Intelligent Connection Technology Co., Ltd. are protected by copyright, trademark right, patent right and other property right laws.
5.2 Without the consent of the relevant right holders and Shenzhen San-Max Intelligent Connection Technology Co., Ltd., the above materials shall not be displayed on any other third-party platforms or used for any other commercial purposes in any way; Users shall not copy, modify, compile the above contents without permission, or create derivative products related to the contents.
6.1 The "privacy" referred to in this Agreement includes the content of Users' personal information as stipulated in Article 4 of the "Regulations on the Protection of Personal Information of Telecommunications and Internet Users" and the content that should be included in privacy as clearly stipulated in laws and regulations formulated or revised from time to time in the future.
6.2 Protecting Users' privacy and personal data is a basic system of Shenzhen San-Max Intelligent Connection Technology Co., Ltd. Shenzhen San-Max Intelligent Connection Technology Co., Ltd. will take various systems, security technologies and procedures to protect Users' privacy and personal data from unauthorized access, use or disclosure, and promises not to disclose the registration information of individual Users and the non-public content stored by Users in Shenzhen San-Max Intelligent Connection Technology Co., Ltd. when using ConfigTool Products to any third parties except cooperative units, or use them for any illegal purposes, except in the following cases:
6.3 In the process of registering a ConfigTool user account or using ConfigTool Product services, Users need to provide some necessary information, such as: name, telephone number, email, gender, date of birth, company name, registered address, registration number, etc. To provide account registration services or identify Users' identities, Users are required to fill in their mobile phone numbers and emails; some functions require Users to authorize the use of their cameras or photo albums; some functions require Users to authorize access to their mobile phone address books, etc. If Users do not authorize or provide incomplete information, they cannot use this service or are restricted during use. For the information authorized by Users, Shenzhen San-Max Intelligent Connection Technology Co., Ltd. promises to take measures to protect the security of Users' personal information.
6.4 To provide Users with a better user experience and improve the service quality of ConfigTool Products, Shenzhen San-Max Intelligent Connection Technology Co., Ltd. may collect, use or provide non-personal privacy information of Users to third parties. Shenzhen San-Max Intelligent Connection Technology Co., Ltd. will supervise and manage the third party's use of Users' personal data, and make every possible effort to protect the security of Users' personal information.
7.1 Users shall abide by national laws, regulations and policies when using ConfigTool Products, and shall be legally responsible for any information and content they create, upload, send and disseminate, which has nothing to do with Shenzhen San-Max Intelligent Connection Technology Co., Ltd.
7.2 Any information and content displayed or pushed to Users on the pages of ConfigTool Products, if recommended to Users by Shenzhen San-Max Intelligent Connection Technology Co., Ltd. through technical means according to Users' instructions after searching, locating and matching from any third-party websites on the Internet, rather than independently created by Shenzhen San-Max Intelligent Connection Technology Co., Ltd., such displayed and pushed information and content do not represent the views of Shenzhen San-Max Intelligent Connection Technology Co., Ltd. and ConfigTool Products, and Shenzhen San-Max Intelligent Connection Technology Co., Ltd. shall not be responsible for the accuracy and correctness of the above information.
7.3 Any text, pictures, logos, audio and video materials contained in the ConfigTool Product services provided by Shenzhen San-Max Intelligent Connection Technology Co., Ltd. are for teaching purposes only and do not involve commercial activities of any physical items.
7.4 If any information and content displayed or pushed to Users on the pages of ConfigTool Products is suspected of infringing the intellectual property rights of any third parties, the right holders and relevant interested parties shall send a right notice to Shenzhen San-Max Intelligent Connection Technology Co., Ltd. After verification, Shenzhen San-Max Intelligent Connection Technology Co., Ltd. has the right to take measures including but not limited to disconnecting the infringing content or deleting and stopping the transmission of the infringing content in accordance with relevant laws and regulations, but Shenzhen San-Max Intelligent Connection Technology Co., Ltd. shall not be legally responsible for the infringing content.
7.5 If Users violate the provisions of this Agreement, resulting in or causing any claims, demands or losses claimed by any third parties, including reasonable attorney fees, Users agree to compensate Shenzhen San-Max Intelligent Connection Technology Co., Ltd. to keep it harmless.
8.1 Shenzhen San-Max Intelligent Connection Technology Co., Ltd. has the right to modify any terms of this Agreement at any time. Once the content of this Agreement is changed, Shenzhen San-Max Intelligent Connection Technology Co., Ltd. will announce the revised agreement content on the ConfigTool App/mini-program platform or announce the revised content to Users through other appropriate means. If Users do not agree to the above revised content, they have the right to choose to stop using ConfigTool, but if Users continue to use it, it shall be deemed that they accept the modification of the relevant terms of this Agreement by Shenzhen San-Max Intelligent Connection Technology Co., Ltd.
8.2 If any term of this Agreement is partially or completely invalid or unenforceable for any reason, the remaining terms of this Agreement shall still be valid and binding.
8.3 The conclusion, execution, interpretation and dispute resolution of this Agreement shall all be governed by the laws of the People's Republic of China and subject to the jurisdiction of the people's courts of the People's Republic of China. If any dispute or controversy arises between the parties regarding the content or execution of this Agreement, it shall first be resolved through friendly negotiation. If the negotiation fails, either party may file a lawsuit with the people's court having jurisdiction at the place where Shenzhen San-Max Intelligent Connection Technology Co., Ltd. is located.
8.4 The copyright of this Agreement belongs to Shenzhen San-Max Intelligent Connection Technology Co., Ltd., and the final interpretation right and modification right of the content of each term of this Agreement belong to Shenzhen San-Max Intelligent Connection Technology Co., Ltd.
